Subject: Disposal of Scarified Bituminous Materials- Regarding

Dear Sir,

With reference to above mentioned subject, we noticed that you are dumping the scarified bituminous materials adjacent to ROW at several locations in the project.

Please refer to clause 3, SI No D.1.1., schedule D of concession agreement” The concessionaire shall secure No-Objection certificate (N.O.C) from land owner/revenue authorities as may be applicable”.

Further your attention was drawn to Attachment D5, Page 302 of concession agreement regarding “Guidelines for identification of Debris disposal sites and precautions needed”.

As per CA D.1.1 Disposal of Debris, scarified bitumen and other wastes it is that

  1. The concessionaire shall secure No-objection Certificate (NOC) from land owner/ Revenue authorities as may be applicable. The disposal of debris, scarified bitumen and other wastes generated during construction shall be carried out as out lined below, and as per item 3.2.6, 3.2.7 in Attachment D 1 -Environmental Management Plan, Attachment D 5 – Guidelines for Identification of Debris Disposal Sites
  2. Disposal Areas:
  • No residential areas are located downwind side of these locations;
  • Dumping sites are located at least 1000 m away from sensitive locations such as all notified forest lands, all water bodies, and productive lands
  • Available waste lands are given preference.
  • Specifications for Waste Disposal
  • In case of bituminous wastes, dumping will be carried out in 30cm thick clay lined pits with the top 30cm layer covered with good earth for supporting vegetation growth over a period only after obtaining permission of Independent Consultant. Care should be taken not to dispose these wastes near farmland.
  • In case of filling of low-lying areas with wastes, it needs to be ensured that the level matches with the surrounding areas. In this case care should be taken that these low lying areas are not used for rainwater storage
  • In case oil and grease are trapped for reuse in a lined pit, care shall be taken to ensure that the pit should be located at the lowest end of the site and away from the residential areas.
  • All arrangements for transportation during construction including provision, maintenance, dismantling and clearing debris, where necessary will be planned and implemented as Approved and directed by the Engineer.

Guidelines for Identification of Debris Disposal Sites 

The locations of dumping sites have to be selected such that:

  • No residential areas are located’ downwind side of these locations,
  • Dumping sites are located at least 1000 m away from forest areas and water bodies
  • Dumping sites do not contaminate any water sources, rivers etc.
  • Dumping sites have adequate capacity equal to the amount of debris generated.
  • Public: perception about the location of debris disposal site has to be obtained before finalizing the location.

Guidelines for Precautions Needed Guidelines for identification           

The concessionaire and the contractor shall take the following precautions while disposing off the waste material

  • During the site clearance and disposal of debris, the concessionaire and contractor will take full care to ensure that public or private properties are not damaged / affected and that the traffic is not interrupted.
  • The concessionaire and contractor will dispose off debris only to the identified places only with prior permission of the Engineers’ Environmental Specialist and the Independent Consultant. , Contractor can also dispose off the debris for the improvements in public utilities ‘after the proper consent of villagers and approval of Engineers’ Environmental Specialist and the Independent Consultant.
  • In the event of any spoil or debris from the sites being deposited on any adjacent land, the concessionaire and contractor will immediately remove all such spoil debris and restore the affected area to its original state to the satisfaction of the Engineers’ Environmental Specialist and the Independent Consultant.
  • The concessionaire and contractor will at all times ensure that the entire existing stream courses and drains within and adjacent to the site are kept safe and free from any debris.
  • The concessionaire and contractor will utilize effective water sprays during the delivery and handling of materials when dust is likely to be created and to dampen stored materials during dry and windy weather.
  • Materials having the potential to produce dust will not the loaded to a level higher than the side and tail boards and will be covered with a tarpaulin in good condition.
  • During disposal of debris, proper warning signs to be installed to the satisfaction of Engineers’ Environmental Specialist and the Independent Consultant.
  • Any diversion required for traffic during disposal of debris shall be provided with traffic control signals and barriers after the discussion with local people and with the permission of Engineers’ Environmental Specialist and the Independent Consultant.
  • During the debris disposal, contractor will take care of surrounding features and avoid any damage to it.
  • While disposing debris / waste material, the concessionaire and contractor will take into account the wind direction and location of settlements to ensure against any dust problems, adequate arrangements will be made to ensure that the debris / waste material is disposed off nearest to the designated dumping site.
  • The report on this activity shall be prepared regularly by Engineers’ Environmental Specialist and the Independent Consultant.

Dear Sir,

With reference to above mentioned subject, we noticed that you are dumping or stacking the scarified bituminous materials adjacent to carriageway at several locations in the project.

At km.17+950LHS the paved and earthen shoulder are encroached by construction materials of dumping or stacking of scarified bituminous materials. These types of stock piles/objects adjacent to the carriageway may impair the user’s visibility in twilight, dark times and may lead to unto wad consequences.

A minimum lateral clearance of 2.5m from the verge of the carriageway shall be maintained as a safety requirement. Further the portion shall properly shield with flexible jercy barriers.
